The privacy world held its breath for a new legal mechanism to ensure a smoother compliance process for transferring personal data to the USA. Since the EU-US Privacy Shield was dead and gone in 2020, organizations scrambled to patch up safeguards for transatlantic transfers, while at the same time praying the situation will be somehow (and swiftly) resolved.
In July 2023, the European Commission finally adopted its decision on the new mechanism proposed by the US for protecting personal data received from the EU – the Data Privacy Framework. Although much-awaited, the DPF is not without critics and some voices say that the new deal will not survive a legal review by the Court of Justice of the EU.
In the next online meeting of the Privacy Learning DPO Community we will discuss how the DPF works and whether or not to get our hopes up for a good level of certainty in transatlantic data transfers.
